These are the terms and conditions which apply when we supply the product(s) to you. The contract is with Mattress 365 Ltd, Unit 1 Beauchamp Industrial Park, Watling Street, Tamworth, Staffordshire, B77 5BZ (hereafter referred to as ‘us’).

These terms and conditions apply to all orders placed via our website (www.mattress365.co.uk) by you acting as a consumer ‘Consumer’ means an individual acting for purposes which are wholly or mainly outside that individual’s trade, business, craft or profession (as defined in Section 2(3) Consumer Rights Act 2015). Where you place an order via our website and are not acting as a consumer these terms and conditions may vary in certain respects. Where there is such a variation this is indicated in these terms and conditions.

We advise that you should read these terms and conditions carefully before placing an order with us. These terms tell you how we will provide the product, how you or we may change or end the contract and what to do if there is a problem with your order, and other important information.

ORDERING/AVAILABILITY.

After placing an order on our website, you will receive an acknowledgement from Us that We have received your order. Please be aware that this does not mean that your order has been accepted. We are not obliged to accept your order and may, at our discretion, decline to accept any order. We will confirm such acceptance by sending you a confirmation that your order has been dispatched. The contract between you and us will only be confirmed when We send you the Order Confirmation. After entering into the Contract, We will be under a legal duty to supply you with goods that are in conformity with the Contract.

We endeavour to keep stock of each product, however, should such issues arise we will contact you to offer a replacement or advise as to how long it will be before the product is back in stock. At this point, we will also offer you a full refund.

DELIVERY.

We will arrange for the product to be delivered to your door. Should there be any problems regarding delivery such as isolated locations, restricted access, we will contact you to make further arrangements as soon as possible.

If at your request, the Products are taken anywhere else on the property when delivered, then we and any third-party contractor will not be liable for any damage to fixtures, fittings or the structure of the property. We accept no liability for the conduct of the third party delivery employee when delivering our Products.

Delivery charges may apply. Scottish Highlands, Northern Ireland, Channel Islands and UK Islands may incur a charge. If this is the case we will be in touch after your order has been placed to advise of any charges. The 365 warranty applies but the cost of the return is at the customer's expense as per the stated charges.

If for any reason you need to change your delivery at short notice to ourselves this may incur a cost in order for us to rearrange.

We accept no liability for any consequential losses incurred in relation to waiting for a delivery (including, but not limited to, time is taken off work to wait for a delivery, whether or not the delivery occurs).

PAYMENTS.

All prices include VAT.

Payment for all orders must be made by credit or debit card on the Buy Now page. We accept payment by most major credit and debit cards.

You should be aware that online payments are subject to validation checks by your card issuer, we are not responsible if your card issuer declines to authorise payment for any reason.

CANCELLATIONS, RETURNS AND REFUNDS.

You may cancel an order any time prior to dispatch.  You may return any of Your Products for a full refund (not including at any time within 365 days after delivery of such Product), provided that Your return meets the conditions herein. 

Refunds will be issued in the form of the original payment.

If you wish to return any Products You purchased from Us within 365 days after you received the Products, please contact Customer Service by email at hello@mattress365.co.uk to arrange for the return.  As soon as the Products have been returned and providing the products are returned in such conditions adhering to our terms and conditions herein, You will be refunded the entire amount paid, less any offer code or other discounts,

The following conditions apply to all product returns. Products returned that do not meet the required terms and conditions following will not be accepted.

  • To return, products must be in a condition with only normal wear and tear. This is at our discretion.
  • As stated at the point of purchase, a mattress protector must be used on all products to maintain the warranty.
  • Products must have been used only for its intended purpose.
  • The return must have been made within 365 days after you took delivery of the Product. 
  • You (and anyone else at Your shipping address) may return a maximum of one (1) of each particular product per shipping address.
  • For all Non-Mattress products, if you advise us you wish to return your unopened product within 14 days of arrival, we provide a full refund for the cost of that item once we have received it back. Should the items be received in a condition other than stated in our terms and conditions, then refunds may be declined.

FAULTY PRODUCTS.

If a Product you order is damaged or faulty when delivered to you or develops a fault, you must contact us as soon as possible by email to hello@mattress365.co.uk, providing us with images and the details of your original order. Nothing in this section affects your legal rights.

PRIVACY POLICY.

We respect all information given to us by You. We do not use the information for anything other than the delivery of your product, where your address and contact telephone number is provided to a third party in order to fulfil your purchase.
